About these terms
KidCommit is provided by ITexperts SIA, a company registered in Latvia under number 48503027270, with its registered office at Dubultu prospekts 62A-13, Jūrmala, LV-2015 (“we” or “us” below). These terms cover our two apps, KidCommit Parent and KidCommit (the app on the child’s phone), our server and this website, together “KidCommit”. They are also the licence agreement for the apps.
By creating an account or using KidCommit, you agree to these terms. If you don’t agree, please don’t use KidCommit. Our Privacy Policy explains what we collect and why.
Who can use KidCommit
- You must be an adult (18, or the age of majority where you live) to create an account or use KidCommit Parent.
- You may add a child only if you are their parent or legal guardian, or look after them with their parent’s or guardian’s permission.
- The app on the child’s phone is for the children you add. You accept these terms on their behalf and are responsible for how the app is used on their phone.
- Use KidCommit only for children in your care. Don’t install KidCommit on an adult’s phone, or on a phone without the knowledge of the child who uses it. The kids app tells the child what it does, including when location is on; please talk it through with your child too.
Your account and family
- You sign in with your phone number and a code we send by text message. Keep your phone, the codes and your Parent PIN to yourself.
- Every adult in a family has the same rights: they can change the rules, give bonus time, see the reports and delete children. Invite only an adult you trust.
- You are responsible for what happens in your account and for keeping your details accurate.
Subscription, trial and payments
- One subscription per family. It covers every child in the family.
- Free trial. A new account can use KidCommit free for 7 days. The trial is given once per phone number.
- Buying. You buy and manage the subscription in the App Store or Google Play. The price, the billing period and any introductory offer are shown there before you confirm. Payment is taken by Apple or Google, and their terms apply to billing, cancellation and refunds.
- Renewal. The subscription renews automatically at the end of each period until you cancel it in your App Store or Google Play account settings. To avoid being charged for the next period, cancel at least 24 hours before the current one ends. After cancelling, KidCommit keeps working until the end of the period you paid for.
- Deleting your account doesn’t cancel the subscription. Cancel it in the store; the app shows how before you delete.
- Refunds are handled by Apple or Google under their policies. Nothing in these terms affects your rights as a consumer, including any right of withdrawal, which you exercise through the store you paid in.
- If the trial or subscription ends, the limits switch off on your children’s phones that day; we remind you two days before. 90 days later we delete the children’s information, with a reminder a week before. Renew before then to keep it.
- If a renewal payment fails, KidCommit keeps working while the App Store or Google Play retries the payment, for up to 16 days. If the payment goes through, your subscription continues from its original renewal date. If it doesn’t, the limits switch off when the store stops retrying.
- Invitations. When a family you invited starts using KidCommit (their child finishes a first task), we add 14 free days to your subscription, for up to 5 families. Free days run after your paid period or trial; if that has already ended, they start on the day the invitation counts. Days you have used don’t come back when you subscribe again. Free days have no cash value. We may stop offering rewards for new invitations; days already earned stay yours.
- Price changes reach you through the App Store or Google Play, with the notice and consent they require.
What KidCommit can and can’t do
- Limits depend on the phone. KidCommit works through the phone’s own features: Apple Screen Time on iPhone, and accessibility, usage access and device administrator on Android. Apple and Google can change them, and a phone setting or a determined child can switch them off. When KidCommit notices that protection is off, it tells you, but we can’t promise that limits can never be bypassed.
- Location is approximate, about 100 metres at best, and updates from time to time. KidCommit is not an emergency or safety service. If you think a child is in danger, contact the emergency services, never rely on KidCommit.
- Episodes and puzzles are for learning and fun. We check the episodes carefully, but a mistake can slip through; tell us and we’ll fix it. They are not professional, medical or safety advice.
- Chores run on trust. KidCommit doesn’t check that a chore was really done. You decide whether a chore needs your approval.
- KidCommit supports your rules; it doesn’t replace you. It helps you set and keep screen time rules, but it’s not a substitute for talking with and looking after your child.
- We keep improving KidCommit, so features can change. If a change takes away something important that you pay for, we’ll tell you in advance.
Using KidCommit fairly
Please don’t:
- use KidCommit to watch anyone without their knowledge, or anyone who isn’t a child in your care;
- break the law, or help anyone else do so, with KidCommit;
- try to get into other families’ information or our systems, or get around our security;
- overload, disrupt or reverse engineer KidCommit, except where the law allows it;
- copy, sell or rent the apps or their content;
- misuse sign-in codes, invite codes or invitation rewards, for example by creating fake families.
Content and licence
- KidCommit, including the apps, episodes, illustrations, narration, puzzles and design, belongs to us or to those who licensed it to us.
- We give you a personal, non-exclusive, non-transferable licence to use the apps on phones you own or control, for your family, while you have an account. On Apple devices the App Store usage rules also apply.
- Some parts of the apps are open-source software, such as puzzles from Simon Tatham’s Portable Puzzle Collection. They come with their own licences, listed in the apps, and those licences apply to those parts.
- What you type into KidCommit, such as chore names and notes, stays yours. You allow us to store and use it only to provide KidCommit to your family.
Suspension and ending
- You can stop using KidCommit and delete your account at any time in the app.
- We may suspend or close an account that breaks these terms, puts a child or anyone else at risk, or when the law requires it. Where we can, we’ll tell you first and give you the chance to put things right.
- If we ever stop KidCommit altogether, we’ll tell you at least 30 days in advance.
Our responsibility to you
We provide KidCommit with reasonable care and skill, and we work hard to keep it running. We can’t promise it will always be available or free of errors.
As far as the law allows, we aren’t responsible for losses that weren’t foreseeable, for events outside our reasonable control, or for what happens when limits are switched off or bypassed on a phone. As far as the law allows, our total liability to you is limited to what you paid for KidCommit in the 12 months before the claim.
Nothing in these terms limits liability that the law doesn’t allow to be limited, including for death or personal injury caused by negligence, or for fraud, and nothing takes away your rights as a consumer.
App Store and Google Play
If you downloaded an app from the App Store:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the apps and their content.
- Your licence lets you use the apps on Apple-branded products that you own or control, as the App Store usage rules allow.
- We, not Apple, are responsible for maintaining and supporting the apps. Apple has no obligation to provide any maintenance or support.
- If an app fails to meet any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the apps.
- We, not Apple, are responsible for handling any claims about the apps, including product liability claims, claims that an app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If anyone claims that an app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending and settling that claim.
- You confirm that you are not in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the apps, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If you downloaded an app from Google Play, Google Play’s terms also apply to your download and payments. These terms are between you and us, not Google.
Questions, complaints or claims about the apps go to us: ITexperts SIA, Dubultu prospekts 62A-13, Jūrmala, LV-2015, Latvia, [email protected].
Changes to these terms
We may update these terms, for example when KidCommit changes or the law does. For significant changes, we’ll tell you in the app at least 14 days before they take effect. If you don’t agree with the new terms, you can delete your account and cancel your subscription before then.
Law and disputes
These terms are governed by the law of Latvia. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. Otherwise, disputes go to the courts of Latvia. Please write to us first: most problems can be solved with one email.
General
- If any part of these terms turns out to be invalid, the rest still applies.
- If we don’t enforce a right straight away, we don’t give it up.
- You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over KidCommit, and we’ll tell you if that happens.
- These terms and the Privacy Policy are the whole agreement between you and us about KidCommit.
